Nayanthara-Surrogacy Controversy


Nayantara and Vignesh Sivan's recently born twins have now been confirmed through surrogacy. The Tamil Nadu Health Department has released the details of the report.

Film actress Nayanthara and director Vignesh Sivan got married on June 9 at a star hotel near Chennai. In this situation, on October 9, Vignesh Sivan shared the pictures with the twins on his social media page and said that he welcomes the new arrival of their family.

But this couple, who posed for a picture with their baby within a few months of their marriage, has raised a debate on social media that they have artificially conceived a child and if they have had these children through surrogacy, they have properly followed the rules.

Tamil Nadu Health Minister said that a committee will be set up and investigated. After Subramanian said, the issue became a talking point.

In this situation, the Tamil Nadu government has issued a press release on the report related to the matter which was investigated by a three-member committee headed by the Joint Director of the Tamil Nadu Health Department. The report, which has come out without mentioning the names of Nayanthara and Vignesh Sivan, contains the information found by the investigation team.

The committee's investigation revealed that the couple had conceived a child through artificial insemination technology and surrogacy at a private hospital in Chennai. A direct inquiry was conducted with the hospital, the treating doctor and the doctors who treated the surrogate during delivery.

The investigation revealed that the ages of the couple and the surrogate were determined in accordance with the Indian Institute of Medical Research (ICMR) Guidelines for Artificial Insemination Technology and Surrogacy.

Investigation revealed that the surrogate mother was of eligible age and married with one surviving child as per Section 3.10.5 of ICMR Guidelines.

A registration certificate was submitted to the couple stating that the marriage took place on 11.3.2016. The authenticity of the marriage registration certificate is verified by the Registry.

As per Section 3.16.2 of the ICMR Guidelines, the medical evidence of the couple's surrogacy was submitted to the Inquiry Committee.

When the doctor who treated the couple at a private hospital was questioned, he mentioned that he had given the treatment based on the recommendation letter issued by their family doctor in 2020. An inquiry at the GP's address revealed that he had been transferred and when we tried to contact him on phone his numbers were not available. Further, the investigation revealed that the doctor had gone abroad, so the team did not investigate the family doctor.

Patient treatment records related to egg treatment are not properly maintained by the hospital.

In August 2020, in vitro egg and sperm were retrieved, embryos were created and stored in cryopreservation at the hospital, and in November 2021, the surrogacy contract was signed. In March 2022, the embryos were implanted into the womb of the surrogate mother and the babies were delivered in October.

Surrogacy is mandatory under the Artificial Insemination Technology Act, but prior to this Act ICMR guidelines allowed non-relatives to act as surrogates and provide payment only for necessary expenses. During the investigation, the surrogate mother was receiving prenatal care at a private hospital in Chennai.

As the embryos developed, the twins were delivered by caesarean section. The babies were delivered to the couple on October 9, 2022.

In this investigation, the committee found the following deficiencies in the private hospital.

As per ICMR guidelines, the hospital should maintain proper records of the treatment given to the couple and the health of the surrogate mother. However, the documents regarding this are not properly maintained in the hospital.

Therefore, a notice has been sent to the artificial insemination center of the private hospital for not following these protocols properly, the press release said.
